3. User Waiver

Due to the speculative nature of cryptocurrency and the emerging technology of smart contracts the user understands that human error is a factor throughout the development process. Brewlabs Collective Pty Ltd will undertake testing and due diligence to reduce possible human error through the development process of the Brewlabs platform however cannot exclusively guarantee that the smart contract will perform to the expectation of the user. The user acknowledges that human error is plausible through smart contract development.

The brewlabs.info and attached subdomains are provided on an “as is” and “as available basis.”

The user acknowledges that Brewlabs Collective Pty Ltd cannot exclusively guarantee the safety and security of the users assets within the Brewlabs platform due to possible future target attacks or other malicious acts towards the platform and subsequently the user agrees that;

Brewlabs Collective Pty Ltd is not responsible for any loss, malfunction, theft, hack, exploitation or other breaches of any or all of users digital assets as a result of the use of the Brewlabs platform or supporting smart contracts across all supported networks.

Brewlabs Collective Pty Ltd is indemnified against any financial or legal claim arising from a breach of security, loss, malfunction, theft, hack, exploitation or other breaches of Brewlabs platform or supporting smart contracts across all supported networks that resulted in loss of the users digital assets.

Brewlabs Collective Pty Ltd will not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Brewlabs Collective Pty Ltd has been advised of the possibility of these damages), resulting from your use of the brewlabs.info and attached subdomains and brewlabs.info and attached subdomains content. Under no circumstances will Brewlabs Collective Pty Ltd total liability of all kinds arising out of or related to your use of the brewlabs.info and attached subdomains or brewlabs.info and attached subdomains content (including but not limited to warranty claims), regardless of the forum and regardless of whether any action or claim is based on contract, tort or otherwise. Each provision of these terms that provides for a limitation of liability, disclaimer of warranties, or exclusion of damages is intended to and does allocate the risks between the parties under this user agreement. This allocation is an essential element of the basis of the bargain between the parties. each of these provisions is severable and independent of all other provisions of these terms. The limitations in this section will apply even if any limited remedy fails for its essential purpose. Users of the Brewlabs platform do so at their own risk and agree that they understand the risks associated with using decentralised applications, smart contracts and cryptocurrency in general.

Brewlabs Collective Pty Ltd is not responsible for the maintenance of and security of user wallet addresses. The user agrees that occasionally and without notice that the availability of the Brewlabs platform may be limited as a result of maintenance, repairs, updates or other necessary development requirements and waives the right to make claim against Brewlabs Collective Pty Ltd for any losses during periods of downtime. The user is responsible for and aware of slashing loss in relation to locked tokens within staking contracts. The user agrees and understands that there is no dedicated support service for the Brewlabs platform.

Brewlabs Collective Pty Ltd is not responsible for any third party products and their performance in relation to their connectivity and compatibility to the Brewlabs platform.
